Abstract

This research is motivated by the importance of implementing integration rights serving as instruments for the rehabilitation and social reintegration of inmates in a manner that transcends mere administrative compliance and effectively prepares inmates for their return to society. The study aims to analyze the implementation of inmates' integration rights at the Class I Correctional Institution in Cirebon in light of relevant laws and regulations, while identifying the factors that facilitate or hinder this process. A qualitative method was employed, specifically a socio-legal (empirical-juridical) approach combining statutory analysis with empirical fieldwork. Data were gathered through observation, interviews with Community Guidance Officers, and a review of documents and literature during a field internship (PPL) conducted from July 22 to August 22, 2026; the data were subsequently analyzed using a descriptive-qualitative method involving data reduction, presentation, interpretation, and conclusion drawing. The results indicate that the implementation of integration rights namely Conditional Release (PB), Conditional Leave (CB), and Pre-Release Leave (CMB) is normatively consistent with Law Number 22 of 2022, Government Regulation Number 31 of 1999, and the Regulation of the Minister of Law and Human Rights Number 3 of 2018 (as last amended by Regulation Number 16 of 2023). Data show that 174 inmates obtained integration rights in 2025, and 81 inmates were granted Conditional Release between January and July 2026. The findings reveal an "implementation gap" rather than a "legal gap," influenced by factors such as inmate behavior and engagement in rehabilitation programs, family support, staff capacity, and acceptance by the community and victims. The study underscores the need to strengthen rehabilitation efforts, coordination between correctional institutions and community guidance agencies (Lapas-Bapas), family support, human resource capacity, and social environment readiness to ensure that integration rights function effectively as instruments for social reintegration.
