Abstract

This research is motivated by the crucial role of the Public Prosecutor in assessing the completeness of case files for premeditated murder during the pre-prosecution stage, ensuring that both formal and material requirements are met and that the case is ready for evidentiary presentation before being referred to court. The study aims to analyze the Public Prosecutor's role in determining the completeness of premeditated murder case files based on applicable laws and to formulate an ideal execution of this role to achieve effective and equitable law enforcement. A qualitative method was employed, utilizing a normative-empirical juridical research design and incorporating statutory, conceptual, and empirical approaches. Data were gathered through a literature review of legislation, books, journals, and prior studies, as well as through observation during a field internship at the Cirebon City District Attorney's Office. The results indicate that the Public Prosecutor plays a strategic role by verifying, analyzing, and overseeing investigation outcomes specifically by evaluating the interrelationships between facts, evidentiary tools, physical evidence, witness testimonies, and the elements of the crime, particularly the element of premeditation. The findings reveal that file completeness is not merely an administrative matter; rather, it must reflect the substantive adequacy and the construction of the case's evidentiary basis. The study implies a need for objective and measurable file reviews, the provision of concrete instructions for improvement, and strengthened coordination between investigators and Public Prosecutors to minimize repeated file returns, enhance pre-prosecution effectiveness, reinforce legal certainty, and ensure the realization of justice.
